Writ Petition filed under Article 226 of the Constitution of India
seeking issuance of a writ of mandamus directing the respondents to
fix the Pay Band of the members of the Petitioner Association in the
Pay Band of Rs.9300-34800 plus Grade Pay Rs.4200 on par with that
of the Secondary Grade Teachers working in the Central Government
Schools.

ORDER
The writ petitioner is an Association of the Secondary Grade
Seniority Teachers. The Association is aggrieved by the delay on the
part of the Government of Tamil Nadu to fix the pay band of its
members on par with the Secondary Grade Teachers working in
Central Government pursuant to the recommendations made by the
Three-Member Committee.
2. It is the case of the petitioner that its members are working
as Secondary Grade Teachers. The VI Pay Commission recommended
revised scale of pay to the Secondary Grade Teachers on par with that
of the Central Government employees. The Secondary Grade
Teachers, who are working in Central Government are all paid the pay
band of Rs.9300-34,800/= with Grade Pay of Rs.4200/=, but,
however, the Secondary Grade Teachers working in State Government
were not given the benefits. The Government have appointed a Three-
Member Committee to look into the pay anomalies consequent to the
VI Pay Commission Report. Even after submission of report by the

Three-Member Committee, the Government have not taken any action
to re-fix the pay band of the members of petitioner association. The
petitioner is, therefore, before this court seeking appropriate direction
to the respondents to take early decision in the matter.
3. Heard the learned Senior Counsel appearing for the petitioner
and the learned Special Government Pleader on behalf of the
respondents.
4. The first respondent is directed to consider and dispose of the
representation of the petitioner dated 10.9.2013 on merits and in the
light of the VI Pay Commission Report and the Report of the Three-
Member Committee constituted for removing the anomalies. Such
exercise shall be completed within a period of four months from the
date of receipt of a copy of this order.
5. The writ petition is disposed of with the above direction. No
costs.
